By accessing this website, submitting an inquiry, creating an account, or using our services, you confirm that you have read and agree to these Terms and our Privacy Policy. If you act for an organization, you confirm that you have authority to bind that organization. If you do not agree, please do not use the website or services.

FIX Partner provides technology consulting, custom software development, web and mobile development, AI and machine learning solutions, software testing, modernization, managed technology leadership, and digital products. The specific scope, deliverables, milestones, acceptance criteria, fees, and support obligations for an engagement will be defined in the applicable written agreement.

FIX Partner retains ownership of its pre-existing materials, tools, frameworks, know-how, methodologies, trademarks, and reusable components. Ownership and licensing of custom deliverables are governed by the applicable project agreement. Unless expressly permitted, you may not copy, reverse engineer, resell, or create derivative works from our website, products, or proprietary materials.

Each party must protect confidential information using reasonable care and use it only for the agreed purpose. We apply appropriate technical and organizational safeguards to information entrusted to us. Where required, confidentiality, data-processing, retention, security, and incident-response obligations will be set out in an NDA, DPA, or project agreement. Learn more in our Trust Center.

Fees, currencies, invoicing schedules, expenses, taxes, and payment dates are specified in the applicable commercial agreement. Unless stated otherwise, invoices are payable without deduction or set-off, and the customer is responsible for applicable taxes other than taxes on FIX Partner's income. Late or undisputed unpaid amounts may result in suspension after reasonable notice.

We will perform professional services with reasonable skill and care. Except for warranties expressly stated in a signed agreement, the website and services are provided on an "as available" basis to the extent permitted by law. Neither party is liable for indirect, incidental, special, or consequential loss, including loss of profit or data, except where such exclusion is prohibited. Any liability cap and specific remedies will be governed by the applicable agreement and mandatory law.

You may stop using the public website at any time. Project termination rights, notice periods, transition support, payment for completed work, return or deletion of data, and continuing obligations are defined in the applicable agreement. We may suspend access where reasonably necessary to address unlawful use, security risk, material breach, or overdue undisputed fees.

We may update these Terms to reflect changes in our services, operations, or legal requirements. The updated date will appear at the top of this page. Continued use after an update constitutes acceptance of the revised Terms. Unless a signed agreement specifies otherwise, these Terms are governed by the laws of Vietnam, and disputes will be handled by the competent courts of Vietnam. If one provision is unenforceable, the remaining provisions continue in effect.
