AI Use Terms

These AI Use Terms supplement our Terms of Service and apply when artificial intelligence is used in FIX Partner services or customer solutions. A signed agreement, statement of work, or data-processing agreement may define additional requirements and takes precedence if there is a conflict.

1. Scope & Acceptance

These Terms apply to AI-assisted software development, testing, analysis, automation, content generation, data processing, machine-learning systems, and other AI-enabled services supplied or operated by FIX Partner. By requesting or using an AI-enabled service, you agree to these Terms and confirm that you have authority to act for your organization.

2. AI-Assisted Delivery at FIX

FIX Partner may use approved AI tools to support engineering, quality assurance, documentation, research, design, analysis, and delivery operations. AI assists our people; it does not replace professional accountability.

  • Material deliverables remain subject to appropriate human review.
  • AI-generated code is reviewed, tested, and handled through project controls.
  • Tool selection considers the use case, information sensitivity, security, and customer requirements.
  • Project-specific restrictions agreed with the customer will be followed by assigned team members.

3. Acceptable & Prohibited Use

AI-enabled services must be used lawfully and for the agreed business purpose.

You must not use them to:

  • create, distribute, or facilitate unlawful, malicious, or deceptive activity;
  • infringe privacy, intellectual-property, confidentiality, or other rights;
  • bypass security controls or develop malware without an authorized purpose;
  • impersonate people or misrepresent AI-generated material as verified fact;
  • make prohibited discriminatory decisions or cause foreseeable harm to people;
  • process data for which you do not have a lawful basis or required permission.

4. Customer Responsibilities

You are responsible for defining the intended use, supplying accurate project context, obtaining rights to input data, and informing FIX Partner of applicable legal, regulatory, contractual, sector, or residency requirements. You must also evaluate whether an AI-enabled outcome is suitable for your users and operating environment before production use.

5. Data, Privacy & Confidentiality

Customer information is handled according to the applicable agreement, our Privacy Policy, and agreed security controls.

  • Confidential customer data will not knowingly be submitted to public AI tools unless the customer has authorized that use.
  • Personal, sensitive, regulated, or proprietary data should be minimized and protected before it is used with an AI system.
  • Data retention, model training, regional processing, and deletion requirements may be specified in the project agreement or DPA.

6. Third-Party AI Systems

AI solutions may rely on third-party models, cloud platforms, APIs, open-source components, or data services. Their availability, behavior, security features, licensing, and provider terms may change. Where a third-party system is proposed, its role, material limitations, and customer responsibilities will be addressed during solution design or in the applicable agreement.

7. Human Oversight & High-Impact Uses

AI should not be the sole decision-maker for employment, credit, healthcare, legal rights, safety-critical operations, or other decisions that may materially affect a person unless the solution includes suitable legal review, testing, controls, transparency, and meaningful human oversight. The customer remains responsible for final operational decisions made using AI outputs.

8. AI Outputs & Limitations

AI output can be incomplete, inaccurate, biased, outdated, or similar to content produced for others. Unless expressly agreed in writing, FIX Partner does not guarantee that every AI output is unique, error-free, or suitable for a particular purpose. Outputs must be validated according to their risk and intended use before they are relied on or released.

9. Security, Intellectual Property & Liability

Security testing, access control, monitoring, and incident handling are applied according to the agreed solution scope. Rights in customer inputs, custom deliverables, pre-existing materials, third-party models, and generated outputs are governed by the applicable licenses and project agreement. Warranties, remedies, indemnities, and liability limits follow the signed agreement and our Terms of Service to the extent permitted by applicable law.

10. Changes & Contact

We may update these Terms as AI technology, our services, and applicable requirements evolve. The effective date above identifies the current version.
